Prayer in the present petition is for issuance of directions to official respondents No. 1 to 4 for conducting a fair and impartial investigation in FIR No. 5, dated 12.01.2024, under Section 376 of the IPC, registered at Police Station Ghuman, District Batala and also for recording of the statement of the petitioner-prosecutrix for conducting her medical examination as she is alleged to be a raped victim. 2.

Learned counsel for the State, on instructions from ASI Prabhyot Singh, submits that the statement of the prosecutrix under Section 164 Cr.P.C. has already been recorded on 28.02.2024 and the medical examination of the petitioner was also got conducted. 3.

Counsel for the petitioner confirmed the fact of recording the statement of the prosecutrix, as well as her medical examination having been conducted.

Counsel for the State has further informed that though the private respondents No. 5 to 8 (accused) are yet to be arrested but sincere efforts be made by the police to arrest them 5.

Counsel for the petitioner submits that the petitioner has also given a representation dated 17.01.2024 (AnnexureP-4) to the Senior Superintendent of Police, Batala (respondent No. 2) but no action has been taken on it so far.

Keeping in view the above, it is directed that action be taken on the aforesaid representation (Annexure P-4) by the Senior Superintendent of Police, Batala (respondent No. 2) within six weeks from today. 7.

Faced with the above, counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage. 8.

Dismissed as withdrawn, as above.

Pending miscellaneous application (s), if any, shall also stand disposed of.
