With the assistance of the learned State counsel and ASI Gurmukh Suingh, I have gone through the police record. The petitioner has been attributed a kapa blow on the head of complainant Raj Devinder Dhingra. The Radiologist vide his report dated 12.11.2015 has reported that no definite opinion can be given pertaining to the injury received by the complainant on skull. The petitioner has also received injuries on his neck, shoulder, knees and a finger, regarding which an MLR on the basis of his medical examination was prepared on 12.11.2015. In view of unexplained injuries on the person of the petitioner and the indefinite opinion of the Radiologist and the petitioner having already joined investigation, it does not appear to be a case of custodial interrogation.

Accordingly,the petition is allowed. Interim order dated 29.4.2016 is hereby made absolute subject to all the conditions u/s 438(2) Cr.P.C.
