Present petition under Section 438 Cr.P.C. for grant of pre-arrest bail to the petitioner(s) in case FIR No. 26 dated 28.1.2017, registered under Sections 148, 149, 323, 324, 506 & 326 IPC at Police Station Indri, District Karnal.

Learned counsel for the respondent-State, on instructions from Assistant Sub Inspector Ashok Kumar, contended that the petitioners have joined the investigation and even the weapon, used for commission of offence, has been recovered. Learned State counsel further contended that offence under Section 326 IPC has been added on the basis of report made by the PGIMER, Chandgiarh and thus, petitioners would be further required for the purpose of investigation and present petition be dismissed. Criminal Misc. No. M-13528 of 2017 the parties and the fact that initially case under Sections 148, 149, 323, 324 & 506 IPC was registered; the petitioners have joined the investigation and also got recovered the weapon used for the commission of offence, their custodial investigation is not required any further in this case, the present petition is accepted and order dated 21.4.2017, passed by this Court, granting interim pre-arrest bail to them, is made absolute.
