The present Civil Writ Petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for quashing the impugned order dated 18.03.2015 passed by respondent No.2 imposing a punishment of dismissal from service upon the petitioner after his retirement with retrospective effect from 22.11.2001. 2.
Learned counsel would contend that the petitioner was imposed a punishment after retirement with retrospective effect on account of his conviction. Thereafter, the provisional pension and other retiral benefits were stopped and have also not been released. The statutory appeal has been preferred by the petitioner on 30.01.2023, Annexure P-3 and he has received a communication dated 28.07.2023, Annexure P-3, stating therein that this appeal is pending consideration. He thus, at this stage, on instructions, submits that a direction be given to the respondents to decide the same in a time bound manner by granting him an opportunity of hearing.
