(ORAL) In the present writ petition, counsel for the petitioner is aggrieved against the action of the respondents in passing of an order that the petitioner is not entitled for any arrears though the benefit of the increment, as being asked by him, has been given by the respondents. Counsel for the petitioner states that the petitioner is in dark as to why once the arrears have been extended to the similarity situated personnel, but the petitioner has been found not entitled for any arrears. Counsel for the petitioner further states that for the said purpose, the petitioner has served the respondents with a legal notice on 08.10.2018 (Annexure P-6), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.

CWP-5317-2019 -2In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 08.10.2018 (Annexure P-6) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
