HARPREET SINGH BRAR J. (Oral) Prayer in this petition filed under Section 483 of the BNSS, 2023, is for grant of regular bail to the petitioner in FIR No.64 dated 14.04.2018 registered under Sections 307, 473, 212, 216, 201, 148, 149, 120B IPC and Section 25 of the Arms Act, at Police Station Phase-1, District S.A.S. Nagar, Mohali.

Learned counsel for the petitioner wishes to withdraw the present petition, however, confines his prayer to the extent that the petitioner is in custody for the last more than 05 years whereas the complainant and other prosecution witnesses are not appearing before the learned trial Court and their application for examination of witnesses through video conferencing is pending for the last 01 year and the arguments are not being addressed yet. Further the petitioner has already submitted his 'No Objection' for the examination of the prosecution witnesses.

In view of the above, the present petition is dismissed as withdrawn.

However, the learned trial Court is directed to take appropriate measures to record the evidence of the prosecution witnesses. The Senior Superintendent of Police, S.A.S. Nagar (Mohali) is also directed to ensure the presence of the prosecution witnesses before the learned trial Court.
