******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioners in case FIR No.229 dated 12.10.2015 registered for the offences punishable under Sections 406, 417, 420 read with Section 120-B of Indian Penal Code, at Police Station Mullana, District Ambala.
Heard.
Learned counsel for the petitioners and learned counsel for complainant submit that the matter has since been amiably settled in the Mediation and Conciliation Centre of this Court on 23.04.2018. As per settlement, petitioner No.1 Raj Kumar has to pay `60,00,000/- to complainant-respondent No.3 Ram Sarup Gautam and for making this Sachin Mehta 2018.05.14 17:57 I attest to the accuracy and authenticity of this document HIGH COURT, CHANDIGARH
CRM-M-14504-2016 -2payment, he has been allowed time of 8 months, so that he may sell his land and make the payment. On payment, the petitioners will be at liberty to move petition for seeking quashing of the FIR. In view of settlement between the parties, this petition is allowed. Petitioners are directed to surrender before the Investigating Officer within a period of two weeks. In the event of their arrest being required, they shall be released on interim bail for a period of 8 months from 23.04.2018, so as to facilitate payment of `60,00,000/- by petitioner No.1Raj Kumar. In the event of payment being made, this order allowing bail for 8 months will continue till proceedings in this FIR are concluded. However, if the petitioner No.
1 commits default in paying the amount of `60,00,000/-, this order allowing interim bail to the petitioners shall stand withdrawn and they may be taken into custody on expiry of period of 8 months from 23.04.2018.
(iii) that the petitioners shall not leave India without the prior permission of the Court;
