AARADHNA SAWHNEY , J (ORAL) CRM-18774-2026 Prayer in the instant application filed under Section 528 of BNSS is for placing on record order dated 16.03.2026 as Annexure A.1. Allowed, as prayed for, subject to all just exceptions. Main case Invoking powers under Section 319 Cr.P.C, the petitioner, who was summoned as an accused in case FIR No.02 dated 16.01.2025 registered against him, for commission of offences punishable under Sections 376 IPC at Police Station Nayagaon, SAS Nagar Mohali, has filed the instant petition, praying for grant of pre-arrest bail.
A perusal of order dated 26.02.2026 passed by learned Addl. Sessions Judge-cum-Judge, FTSC, SAS Nagar reveals that in compliance of order dated 17.02.2026 passed by this Court, the petitioner has surrendered before the trial court concerned and was extended the concession of bail. 5.
On 17.02.2026, following order was passed by this Court: "Petitioner-Bahid Ali @ Rajudin has filed instant petition under Section 482 of BNSS, 2023, for grant of anticipatory bail in FIR No. 02, dated 16.01.2025, under Section 376 of IPC (now Section MANOJ KUMAR 2026.05.07 22:12 I attest to the accuracy and authenticity of this order
CRM-M-9012-2026 (O&M) 64 of BNS 2023), registered at Police Station Nayagaon, SAS Nagar, Mohali.
It is argued that initially petitioner was not named in the FIR. After investigation, he was not challaned to face trial. During the pendency of trial, an application was filed under Section 319 Cr.P.C. and the present petitioner and co-accused Chunne Shah were summoned vide order dated 15.10.2025 (Annexure P-2). Petitioner is ready to face the trial.

On advance notice, Mr. J.S.Rattu, Deputy Advocate General, Punjab appears and accepts notice on behalf of State. Learned State counsel pointed out that as per the version of prosecutrix, she had named present petitioner and co-accused Chunne Shah but they were not challened by the police. I have considered the aforesaid factual position. Fact remains that the challan was already presented on 28.02.2025. The charges were framed and the present petitioner is summoned on application under Section 319 Cr.P.C.
Considering the aforesaid factual position, petitioner is ordered to be released on interim bail to the satisfaction of trial Court subject to the condition that he will surrender before the trial Court within a span of 10 days, from today.
Adjourned to 18.03.2026, for filing status report." 6.
Keeping in view the above submissions advanced by learned counsel for the petitioner as also the fact that the petitioner has surrendered before the trial Court concerned, interim bail granted vide order dated 17.02.2026 is hereby confirmed, subject to conditions as envisaged under Section 482(2) BNSS. Further the petitioner is directed to continue appearing before the trial Court; he will not tamper with the evidence nor will influence the witnesses and will not leave the country without prior permission of the Court. 7.
The petition stands allowed.
