Petitioners have filed the present petition under Section 528 of the BNSS, 2023, for quashing of complaint case under Section 138 of the Negotiable Instruments Act, 1881 (in short, 'NI Act') bearing No. NACT No.1613/2023, dated 20.11.2023, titled as, "Saranjeet Singh v. Om Harishanker Enterprises and another" (Annexure P-7) along with summoning order dated 12.08.2024, passed by Ld. JMIC, Ferozepur (Annexure P-8), and all consequential proceedings arising therefrom. 2.

Counsel for the petitioners admits that petitioners have not challenged the summoning order before the Revisional Court i.e. Court of Sessions, at the first instance and has directly approached this Court by way of present petition.

In view of the above, present petition is disposed of, by observing that in case, petitioners choose to file a revision petition before Court of Sessions within a period of two weeks from today, same would be JAWALA RAM 2025.02.27 11:38 I attest to the accuracy and authenticity of this document
