ARUN MONGA, J.(ORAL) Having suffered adverse findings by Ld. First Appellate Court reversing that of Ld. Trial Court judgement and decree dated 07.06.1990 on issue No.2, plaintiffs/appellants are in second appeal before this Court assailing judgment and decree dated 03.11.1992 passed by Ld. First Appellate Court. 2.

Petition was admitted for hearing on 18.11.1993. 3.

Case was taken up for hearing on 08.12.2022 when there was no representation on either side and registry was asked to issue notice to the parties as well as their respective counsel. As per office note, appellant No.1, 3 and 4 have expired, appellant No.2 has been duly served, respondents No.1 to 5, 7 & 8 have expired and respondent No.6 is stated to be residing in her in-laws house. Even learned counsel for respondent No.1 has been informed through E-mail. However, on resumed hearing, same is the position today and none causes appearance even on behalf of parties who have been served and they chose not to appear. Even no steps have been taken to implead the LRs of appellants No.1, 3 & 4 who have died during pendency of appeal.

Appeal is dismissed for non-prosecution.
