ARVIND SINGH SANGWAN J. (Oral) The petitioner alleges violation of the order dated 19.01.2021, vide which a direction was issued that the recovery from the petitioner will remain stayed till the next date of hearing. Counsel for the petitioner submits that the writ petition is still pending, however, despite the order, the respondents/authorities have effected the recovery of Rs.5,000/- each for a period of 02 months. Counsel for the respondents submit that the amount so recovered has been refunded back on 15.03.2021. It is further submitted that the respondents were not served with the order when the recovery was effected.

Be whatsoever, considering the fact that the order dated 19.01.2021 was violated, though the same has been reversed by the respondents/authorities, this petition is disposed of directing the respondents/authorities to pay Rs.5,000/- to the learned counsel for the petitioner towards the litigation expenses, within a period of 02 months from today.
