The petitioner is seeking the concession of bail under Section 438 Cr.P.C. in case FIR No.86 dated 28.02.2018 under Sections 406, 420, 506 IPC registered at Police Station Line Par Bahadurgarh, District Jhajjar. 2.

On 26.05.2023, while noticing the following submissions made by learned counsel for the petitioner, this Court had granted the concession of interim bail to the petitioner and asked him to join investigation. "The petitioners are seeking the concession of anticipatory bail under Section 438 of the Cr.P.C. in case FIR No.86 dated 28.02.2018 under Sections 406, 420 and 506 of the IPC registered at Police Station Line Par Bahadurgarh, District Jhajjar.

Learned counsel appearing for the petitioner in CRMM8491-2019 submits that the matter stands resolved between the parties.

Adjourned to 11.08.2023.

Meanwhile, the petitioners is directed to join the ARCHANA ARORA 2023.10.07 10:22 I attest to the accuracy and integrity of this order/judgment investigation and appear before the investigating agency as



   

 and when called upon to do so. In the event of their arrest, they shall be admitted to interim bail on their furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. The petitioners shall abide by the terms and conditions as envisaged under Section 438(2) Cr.P.C.

A photocopy of this order be placed on the file of other connected case."

Learned counsel for the petitioner submits that in compliance of the order dated 26.05.2023, the petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions from ASI Gurnam Singh does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, further submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In the circumstances, the petition is allowed and the interim order dated 26.05.2023 is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C. Needless to say, in case the petitioner misuses the concession of bail granted to him, the State would be at liberty to seek cancellation of the bail granted to him.
