Learned State counsel contends that petitioners were appointed as Water Carriers for one and a half hour per day on DC rate/ daily wage, on year to year basis, and their services were terminated on 28.02.2003. Thereafter, the Department did not grant sanction for appointment of Water Carriers for the year 2003-04 because water facility had been provided in every school in terms of directions issued by this Court in CWP-3774-2000, obviating the need for appointment of part-time Water Carriers. Learned counsel for the petitioners is not in a position to dispute any of the facts aforementioned, nor have the petitioners challenged their termination dated 28.02.2003. 4.
It is, therefore, apparent that the petitioners' services as part-time Water Carriers were terminated for a valid reason on 28.02.2003, which has not even been challenged by them. 5.
