(Oral) This is a petition under Section 438 Cr.P.C. seeking pre-arrest bail to the petitioner in a case registered against him vide FIR No.68 dated 29.05.2016 under Section 22 of the NDPS Act, at Police Station Sadar Kapurthala, District Kapurthala.

Allegation against the petitioner is that he was in possession of 260 Grams of intoxicating powder containing 'Alprazolam', which is a commercial quantity. He was earlier granted concession of interim bail as FSL report had not been received. On receipt of the report, bail granted to the petitioner has been cancelled. He is, thus, required to surrender before the concerned court.

In view of the above, no case for grant of concession of pre-arrest bail is made out. Dismissed.
