The petitioner allegedly escaped from the spot but he has been named by his co-accused Roshan Singh, who has been apprehended from the spot along with 300 kgs of poppy husk contained in 15 bags. Learned State counsel has opposed the petition on the ground that in the secret information the name of the petitioner is specifically mentioned. It is a fact that no recovery has been effected from the petitioner, except a pistol of .12 bore along with few live cartridges. The petitioner has been in custody since 17.12.2015. Challan having already been presented; six prosecution having already been examined, the petitioner can be granted the concession of bail. The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court.
