**** RITU BAHRI, J. (Oral) Present petition is for release of petitioner on regular bail in FIR No.498 dated 17.11.2016, under Sections 498-A, 304-B and 34 IPC, registered at Police Station Mahendergarh.
Learned counsel for the petitioner submits that the petitioner was serving as Airmen in Indian Air Force and his marriage was solemnized with Alka @ Priyanka (since deceased) on 05.02.2016. The petitioner had left his home on 05.11.2016 whereas his wife had committed suicide on 17.11.2016. In the marriage, a swift car was given to the petitioner and the allegation in the FIR is that he was demanding the bigger car within 9 months of the marriage.
Learned State counsel, on instructions from investigating officer, has informed that the charge has been framed and 19 witnesses is to Naresh Kumar 2017.04.28 11:10 I attest to the accuracy and integrity of this document Chandigarh be examined in the present case.
CRM-M-13675-2017 -2I have heard the learned counsel for the parties and with their able assistance gone through the material available on record. The petitioner was arrested on 28.11.2016. Since then, he is in judicial custody and no useful purpose would be served to further detain him in jail. Moreover, the allegation with regard to demand of bigger car, inter alia, would be the moot point to be decided during the course of trial, after acceptance of the evidence, by the trial Court. The final conclusion of trial will take a long time.
In view of above facts, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned trial Judge/Duty Magistrate, Narnaul.
Needless to mention that, nothing observed here-in-above, would reflect, on merits in the trial of the main case, in any manner.
