The present application has been filed for placing on record the representation dated 05.06.2025 made by the petitioner to the Estate Officer, U.T., Chandigarh as Annexure A-1.

Learned counsel for the applicant/petitioner seeks to withdraw the present application with liberty to avail alternate remedy as is available under the law.

Dismissed as withdrawn with liberty aforesaid. 1.

The present contempt petition has been filed for deliberate and intentional disobedience of order dated 03.08.2022 passed by the Co-ordinate Bench of this Court in CWP-6884-2022.

Vide order dated 03.08.2022, the following direction was issued by the Co-ordinate Bench of this Court:- "In view of above, present petition is disposed of with a direction to the respondents to process the application of the petitioner to transfer the property of the petitioner in terms of the notification aforesaid."

Reply by way of affidavit of Naveen, DANICS, Assistant Estate Officer, U.T., Chandigarh, has been filed on behalf of the respondents. The same is taken on record. The relevant portion of the said reply is reproduced as under:- "4.

That in compliance of the order dated 03/08/2022, the Estate Office Union Territory, Chandigarh has processed the case of the petitioner in terms of the notification dated 12/11/2018 as applicable to leasehold properties and have asked the petitioner to deposit the unearned increase amounting to Rs.10,59,195/- as per the terms and conditions of the letter of allotment no. 13(a) and Rule 7 of the Chandigarh Estate Rules, 2007 vide office memo no. 520657/LRP-927/GV/2024 dated 31/07/2024 and have also asked the petitioner to furnish afresh Indemnity Bond and Liability Affidavit that he will pay the dues, if any pending, on account of ground rent. The copy of the letter dated 31/07/2024 is appended herewith as Annexure R-1.

That the petitioner has deposited the unearned increase amounting to Rs.10,59,195/- and office of the answering Respondents has already issued transfer letter bearing No.1/32407/LRP-927/G-V/2024 dated

-310.12.2024. The copy of the transfer letter dated 10/12/2024 is appended herewith as Annexure R-2." 4.

Learned counsel for the respondents contends that order dated 03.08.2022 passed by learned Single Bench has been complied with. Learned counsel for the petitioner does not dispute the same. 5.

In view of the above, the present contempt is purged and rule is discharged.
