NIDHI GUPTA, J. (ORAL) The appellant/plaintiff is in appeal against the concurrent findings of the learned Courts below, whereby the suit for permanent injunction filed by the appellant/plaintiff, has been dismissed by both the Courts below.

At the very outset, learned counsel appearing on behalf of the appellant submits that there has been change in counsel as the previous counsel representing the appellant has unfortunately passed away and, therefore, he files Power of Attorney in Court today, which is taken on record.

Learned counsel for the appellant further submits that he may be permitted to withdraw the present appeal as it is stated that a Civil Writ Petition bearing No. 7784 of 2021 has already been filed which is pending before this Court.
