*** Daya Chaudhary, J. (Oral) The present petition has been filed by petitioner-Talwinder Singh under Section 439 Cr.P.C. for grant of regular bail to him in case FIR No.50 dated 17.06.2016 registered under Sections 307, 392, 394 read with Section 34 IPC and Section 25,54,59 of the Arms Act at Police Station City Fazilka, District Fazilka.

Learned counsel for the petitioner submits that the petitioner is in custody since 17.06.2016 and in two more pending cases, he is on bail. After presentation of challan, charges have been framed and all the material witnesses have been examined/cross-examined. Still trial may take some time to conclude as not only remaining witnesses are still to be examined but statement of defence witnesses is also to be recorded. No purpose would be served by keeping the petitioner in custody. Learned State counsel has not disputed the custody period as well as stage of trial and also the fact that eye witness and other material witnesses have been examined.

Keeping in view the submissions made by learned counsel for the petitioner that the petitioner is in custody since 17.06.2016; all the material witnesses have been examined; in other two more pending cases, the petitioner is on bail; the trial may take time to conclude; no purpose would be served by keeping the petitioner in custody, the present petition is allowed and the petitioner (Talwinder Singh) is directed to be released on regular bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court.
