The present revision petition has been filed under Article 227 of the Constitution of India challenging the order dated 25.09.2023 dismissing the application under Order 7 Rule 11 of the Code of Civil Procedure, 1908 for rejection of the plaint and order dated 31.01.2024 whereby the cross-examination of PW1 - Satish Chugh (respondent No.1 herein) - was ordered to be treated as nil.

Learned counsel for the plaintiff-respondent No.1 states that as per the order dated 25.09.2023 the plaintiff-respondent No.1 would deposit the tentative court fee and he would stand by the affidavit filed by him wherein he has undertaken that in case the decree is passed and the Court considers that the court fee is payable, the plaintiff-respondent No.1 shall abide by the same and pay the court fee.

In view of the statement made by the learned counsel for the plaintiff-respondent No.1, the learned counsel for the defendant-petitioner Yogesh Sharma 2025.03.06 09:50 I attest to the accuracy and authenticity of this order/judgment.

CR-1211-2024 (O&M) -2states that he does not wish to press the present revision petition to that extent.

Learned counsel for plaintiff-respondent No.1 further states that he has no objection if an opportunity is given to the defendant-petitioner to cross-examine PW1. He also states that he waives off the costs imposed by the Trial Court upon the defendant-petitioner vide order dated 03.11.2023. The learned counsel for plaintiff-respondent No.1 prays that the matter has been pending for the last 05 years and, hence, the Trial Court may be directed to dispose off the matter expeditiously. 5.
In view of the above, the present revision petition is allowed to the extent that the costs imposed vide order dated 03.11.2023 stand waived off and further the defendant-petitioner is granted one opportunity to cross-examine PW1 - Satish Chugh (respondent No.1 herein). 6.
Keeping in view the fact that the matter has been pending for the last five years, the Trial Court is requested to decide the matter expeditiously and in accordance with law.

Disposed off accordingly. Pending applications, if any, also stand disposed off.
