Learned counsel appearing for the appellant submits that during the pendency of the appeal, respondent No.1- Nanak Singh has expired. She submits that in spite of making best efforts, she was not able to contact the legal representatives of respondent No.1. 2.

Learned counsel appearing for the appellant further submits that judgment and decree of the learned First Appellate Court, which is under challenge in the present regular second appeal has already been stayed by this Court, hence, the present regular second appeal may kindly be disposed of having been not pressed any further with liberty to revive the same in case, any effort is made by the respondents to get the judgment and decree of the learned First Appellate Court executed.
