MADAAN Present:- Mr. Sandeep Arora, Advocate for the petitioner. *** Both the Courts below have returned finding that since the property from which the trees were allegedly cut by the accused party happen to be joint, therefore, no offence under Section 379 IPC was disclosed and evidence was also lacking as regards offence under Section 506 IPC. The trial Magistrate had declined to summon the accused to face the trial and on a Criminal Revision having been filed by the complainant challenging that order such finding of trial Magistrate was affirmed. I do not see any reason to interfere with such orders while exercising jurisdiction under Section 482 Cr.P.C.

Therefore, the petition stands dismissed.
