Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.260 dated 04.11.2014 under Sections 307, 452 and 34 IPC and Section 25 of the Arms Act, registered at Police Station Beri, District Jhajjar.

Notice of motion On asking of the Court, Mr.Vikramjit Singh, Addl. Advocate General, Haryana, who is present in the Court, accepts notice on behalf of the respondent-State and contests the petition. Police record is also available.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the petitioner is not named in the FIR. CRM No.M-14690 of 2016 -2accused with intention to kill the complainant. It is argued by learned counsel for the petitioner that the complainant while appearing in the Court has not identified the present petitioner.

The petitioner is in custody since 17.06.2015. He is no more required for interrogation or investigation purposes. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody.

Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bonds in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
