***** Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.18 dated 17.03.2017 under Sections 120-B, 420, 465, 467, 468 and 471 IPC, registered at Police Station Badhni Kalan, District Moga.
Allegation against the petitioner is that he took amount of Rs. 8,50,000/- for sending daughter of the complainant abroad. On the allegation that he committed a fraud with the complainant, aforesaid FIR was registered and investigation ensued. Challan has now been presented and trial is in progress. Petitioner is incarcerated since 08.11.2017. Case is triable by Magistrate.
It appears that no useful purpose would be served by detaining the petitioner any longer. Thus, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner is directed to be released on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Moga.
