Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.0136 dated 13.09.2016 under Sections 341, 323, 506, 148, 149 IPC and Section 3 of the Prevention of Damage to Public Property Act, 1984, registered at Police Station Sadar Sangrur, District Sangrur.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per the FIR, allegation against the petitioner is that he caused damage to solar lights which are installed in Vineet Gulati 2017.05.02 16:18 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-13794 of 2017 -2the streets of the village. The photographs have been shown by learned State counsel. In the photographs, the main damage is to cemented portion of the foundation of the pole. Learned counsel for the petitioner states that no damage has been caused to the solar panels or lights. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find that no useful will be served by sending the petitioner to custody.

Therefore, finding merit in the present petition, the same is allowed. It is ordered that in the event of arrest, the petitioner be released on bail subject to his furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438 (2) Cr.P.C.
