ARUN MONGA, J. (ORAL) Matter was taken up for hearing on 22.03.2023, when learned counsel for appellants appeared and stated that all her efforts to contact the clients have been futile and being an old matter, Registry was asked to issue notice to appellants. Needful has been done. Office report reveals that appellants No.1 and 5 have died. However, none appeared for respondents No.2 to 4, despite service. Since neither legal heirs have taken any steps to get themselves impleaded, nor appellants No.2 to 4 have come forth to contest the appeal. Though one learned counsel for appellants appeared on last date of hearing but even she did not have power of attorney to appear on their behalf. It seems that by sheer effluxion of time and pendency of appeal for the last 30 years, they have lost interest in pursuing the appeal. In the premise, instant appeal is dismissed in default.
