The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.52 dated 28.7.2015 registered for the offence under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the Act') at Police Station Sadar Rampura, District Bathinda.

Notice of motion has been issued in this case. Mr. V.P.S. Sidhu, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Assistant Advocate General, Punjab appearing for the respondent-State and have gone through the record.

From the record, I find that recovery from the petitioner is 5 Harpal Singh Parmar 2017.05.25 17:06 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-13805 of 2017 [2] Kgs. of poppy husk and he was already on bail. He had absented from Court proceedings on 29.8.2016. Now the petitioner has surrendered before the trial Court in pursuance of the interim order passed by this Court and he has been released on interim bail by the learned trial Court as stated by the learned counsel for the petitioner. Therefore, no useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the present case; I find merit in this petition and the same is allowed. The interim order dated 25.4.2017 passed by this Court granting interim bail to the petitioner is made absolute.
