IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No.5362 of 2019 Date of Decision : 03.12.2019 Krishan Singh and others ....Petitioners

Versus

State of Punjab and others

...Respondents

CORAM : HON'BLE MR.JUSTICE TEJINDER SINGH DHINDSA ...

Present : Mr.Ashok Bhardwaj, Advocate for the petitioners.

...

TEJINDER SINGH DHINDSA, J.(ORAL) As per averments made in the writ petition, the petitioners who are three in number are working as Pump Operators on contractual basis under the Punjab Water Supply and Sewerage Board. Counsel concedes that the engagement of the petitioners was through an outsourcing arrangement.

A writ of Mandamus is sought directing the respondent authorities to regularise the services of the petitioners as they have been working since long.

Instant writ petition had come up for preliminary hearing before this Court on 27.02.2019 and counsel had sought time to place on record relevant material/documents to substantiate that each one of the petitioners fulfills the eligibility conditions under Section 6(a) and (b) of the Punjab Adhoc, Contractual, Daily Wage, Temporary, Work Charged and Outsourced Employees Welfare Act, 2016 so as to press for regularisation.

CWP No.5362 of 2019 -2In spite of repeated opportunities having been availed, the necessary material/documents has not been placed on record. Even today learned counsel submits that application(s) have been moved under the provisions of Right to Information Act to seek the necessary information.

In view of the above, the instant writ petition is disposed of as withdrawn with liberty to the petitioners to approach this Court afresh raising the same very prayer but by placing on record material/documents to demonstrate eligibility of the petitioners for regularisation as per provisions of the Punjab Adhoc, Contractual, Daily Wage, Temporary, Work Charged and Outsourced Employees Welfare Act, 2016.

Disposed of.
