& &!% $, CRM-10185-2024 This application is moved under Section 482 Cr.P.C. to place on record copy of the post mortem report as Annexure P-2 and to exempt filing certified copy thereof.

CRM-M-10631-2024 By way of this petition filed under Section 438 Cr.P.C.,petitioner is seeking anticipatory bail in case FIR No.146 dated 07.12.2023 under Sections 304, 506, 34 IPC, registered at Police Station Jodhewal, District Police Commissionerate, Ludhiana.

 

 

2024:PHHC:049696 Learned counsel contends that Sulekha, the sister of the petitioner was married to Rohit Sehgal. Naresh, the nephew of the deceased was the friend of Rohit Sehgal. Due to matrimonial discord between Sulekha and Rohit Sehgal, Naresh came close to the family, won over the confidence of Sulekha, which resulted in an affair. A meeting between the two families was taking place so as to resolve the dispute arising out of this affair and as per the allegations made in the FIR, during that meeting, petitioner and others pushed Balwant Verma(deceased), who fell down and ultimately died. Learned counsel contends that death of Balwant Verma has been used to implicate the petitioner falsely inasmuch as the said death was natural.

Learned counsel has drawn attention towards the postmortem report (Annexure P-2) as per which the cause of death was cardiac rupture, though, the viscera was kept for chemical examination for any intoxication.

Notice of motion.

Mr. Amandeep Singh Sandhu, DAG, Punjab, accepts notice on behalf of the respondent-State. Copy of the petition be supplied to him during the course of the day.

In the meantime, in case of arrest, the petitioner shall be released on interim bail subject to the satisfaction of the Arresting Officer/Investigating Officer. However, it is directed that the petitioner shall join the investigation as and when so required by the Investigating Officer. He shall not contact any person associated with the case to dissuade him from the investigation in any manner whatsoever and nor shall leave the country without prior permission of the Court. He shall further comply with the conditions stipulated in Section 438(2) Cr.P.C. -%
