The present application has been filed for restoration of the main case (CR-1288-2024) which was dismissed for non-prosecution vide order dated 14.10.2025.

There would be no requirement for issuance of notice as none had put in appearance on behalf of the respondent in the main case despite service.

For the reasons stated in the application, the same is allowed. The main case (CR-1288-2024) is restored to its original number and with the consent of the learned counsel for the applicant-petitioners, the same is taken on Board today itself.

The present revision petition has been filed under Article 227 of the Constitution of India challenging the impugned order dated 03.02.2024 YOGESH SHARMA 2026.01.30 10:30 I attest to the accuracy and authenticity of this order/judgment.

In the interregnum, vide judgment and decree dated 30.01.2025 the main suit itself has been dismissed as being barred by the principle of res-judicata.

In view thereof, the present revision petition is dismissed as having been rendered infructuous. Pending applications, if any, also stand disposed off.
