This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 156 dated 26.10.2014 under Sections 307, 148, 149 IPC and sections 25/27/54 of the Arms Act at Police Station City Malout, District Sri Muktsar Sahib.

Learned counsel for the petitioner contends that this is a case of version and cross-version. Accused in the FIR also suffered injuries regarding which a separate DDR was registered. According to him, only role attributed to the petitioner is that he gave a iron handle blow on the wrist of injured Gaurav Sharma. Thus, no useful purpose would be served by detaining the petitioner in custody any longer.

Learned State counsel has opposed the prayer for bail. He submits that law and order situation was created due to the entire episode.

CRM-M 13822 of 2015 Keeping in view the fact that petitioner is stated to be in custody since 21.11.2014 and have caused one injury on the wrist of one of the injured, I am of the considered view that that no useful purpose would be served by detaining him in custody any longer. Without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner. Accordingly, petition is allowed and petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Sri Muktsar Sahib.
