2023:PHHC:047415
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH RSA No.2048 of 1993 (O&M) DATE OF DECISION : 22.03.2023 Biro and others ...Appellants
Versus
Ganga Devi and another
...Respondents
CORAM : HON'BLE MR. JUSTICE ARUN MONGA Present :
Mr. Rajender Goel, Advocate, For the appellants.
None for the respondents.
ARUN MONGA, J. (ORAL) Matter was last taken up for hearing on 16.01.2023, when none appeared for the parties and Registry was asked to issue notice to the parties. Needful has been done.
On resumed hearing today, learned counsel though appears out of professional courtesy as his father, who had filed the instant appeal, has since expired and he failed to establish contact with clients. As per office report, appellants No.1,12 and 14 are reported to have died. Some of the appellants are intentionally evading the service. Legal heirs of deceased appellants have not come forth to take any steps for their impleadment. It seems that appellants are not interested in pursuing instant appeal.
In the premise, instant appeal is dismissed for nonprosecution with liberty to revive the same in case anything survives. Pending applications, if any, shall also stand disposed of. MARCH 22, 2023 (ARUN MONGA) Shalini JUDGE Whether speaking/reasoned : Yes/No Whether reportable :
