*** RAJ MOHAN SINGH (Oral) The case has been taken up for hearing through videoconferencing. Petitioner seeks grant of anticipatory bail in case bearing FIR No.170 dated 31.12.2019, registered under Section 61 of the Punjab Excise Act, 1914, at Police Station Dinanagar, District Gurdaspur, Punjab.
Notice of motion was issued on 28.02.2020 and interim anticipatory bail was also granted on the premise that the Addl. Sessions Judge, Gurdaspur at one point of time granted anticipatory bail to the petitioner vide order dated 06.02.2020 and directed her to join the investigation. The investigation was joined by the petitioner on 09.02.2020 and recovery was also effected but the application for grant of anticipatory bail was dismissed in view of the antecedent MAMTA MALHOTRA 2021.09.24 15:46 I attest to the accuracy and integrity of this document Chandigarh
CRM-M-8769-2020 -2history of criminal activity of the petitioner. Learned counsel for the petitioner submits that in compliance of order dated 06.02.2020 of Addl. Sessions Judge, Gurdaspur and in compliance of order dated 28.02.2020 of this Court, the petitioner has joined the investigation. Learned State counsel on instructions from ASI Gurdev Singh admitted the aforesaid fact and submitted that the petitioner is no more required for further investigation of the case. Even challan has been submitted to the competent Court.
In view of aforesaid factual position, the interim order dated 28.02.2020 is made absolute. Petitioner shall appear before the trial Court regularly.
Petition stands disposed of.
