*** RAJESH BHARDWAJ, J. (ORAL) Present writ petition has been filed for directing respondents No.2 to 7 to restore the damaged water channel outlet No.145000/L Sub Sundar branch in view of the order dated 20.12.2017 (Annexure P-2) passed by Sub Divisional Canal Officer, order dated 02.11.2020 (Annexure P-6) and order dated 08.01.2021 (Annexure P-8) passed by Sub Divisional Officer (Civil), Narnuand and necessary directions be also issued to initiate action against the wrong doer-respondents No.8 and 9 in view of Section 58 of Haryana Canal and Drainage Act of 1974. Learned counsel for the petitioner has submitted that for the redressal of his grievance, the petitioner has already filed representation dated 09.02.2021 (Annexure P-9) before respondent No.4 but no action has been taken on the same till date.

CWP No.4737 of 2024 -22024:PHHC:028728 On asking of the Court, Ms. Upasna Dhawan, AAG, Haryana appears and accepts notice on behalf of respondents No.1 to 7State. She has submitted that for the redressal of his grievance, if the petitioner files fresh representation before respondent No.4, then respondent No.4 would decide the same expeditiously. Learned counsel for the petitioner submits that the petitioner be granted liberty to file a fresh representation before respondent No.4 i.e. the Deputy Commissioner, Hissar and he be directed to decide the same in a time bound manner.

After hearing both the parties and perusing the record, the present petition is disposed of with liberty to the petitioner to file his appropriate representation before respondent No.4 as prayed for within a period of ten days from today. If any such representation is filed by the petitioner within the stipulated period, then respondent No.4 i.e. the Deputy Commissioner, Hissar is directed to decide the same in accordance with law expeditiously preferably within a period of two months from the date of its filing.
