The petitioner seeks grant of regular bail in respect of a case registered vide FIR No.06, dated 10.1.2021, Police Station Sadar Malout, Tehsil Malout, District Sri Muktsar Sahib, under Sections 15(b) and 21(b) of NDPS Act wherein it is alleged that he was found in possession of 4 kgs of 'Poppy Husk'.

Learned State counsel has informed that in the instant case the petitioner has been behind bars for the last about two and a half months and that challan already stands presented. 3.

Bearing in mind the nature and quantity of the contraband allegedly recovered which would fall in the category of non-commercial quantity and that the challan already stands presented, further detention of the petitioner will not serve any useful purpose. The petition, as such, is accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
