Learned counsel for the petitioner places reliance on the judgment passed by this Court in Amarjit Kaur and Another vs. State of Punjab and Others, CWP-27047-2019, which was decided on 27.04.2022, in view of the law laid down by Hon'ble the Surpeme Court in Prem Singh vs. State of Uttar Pradesh and Others in Civil Appeal No.6798 of 2019, decided on 02.09.2019 as also in Surjit Kaur vs. State of Punjab and Others, CWP-1824-2014, decided on 16.01.2015, against which LPA-771-2015 filed by the State of Punjab was also dismissed on 29.04.2016. He thus, at this stage, on instructions from the petitioner, prays that a direction be given to the respondents to consider his claim in terms of the aforesaid judgments, in a time bound manner, to which learned State counsel has no objection.

In view of the above and without commenting on the merits of the case, this petition is hereby disposed of with a direction to the respondents to consider and decide the claim of the petitioner, taking note of the afore-referred judgments, within a period of 4 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon          !" "# %
