The petitioner through instant petition under Article 226 of the Constitution of India is seeking setting aside of order dated 05.08.1997 (Annexure P-19) and directions to respondent to grant him consequential benefits of service as well as accord seniority with effect from 31.10.1956. 2.
The petitioner joined as Electrical Overseer on 09.01.1956. After re-organisation of States, he was deputed to Punjab State Electricity Board which absorbed him with effect from 01.02.1958. After bifurcation of State of Punjab, he was allocated to Haryana State Electricity Board. He was promoted to the post of Junior Engineer on 09.11.1971. He retired on attaining the age of superannuation on 31.08.1990.

CWP No. 2608 of 1998 (O&M) -2thereafter started making representations claiming seniority. His claim was rejected. He passed away on 27.01.2011.

The petitioner was granted benefit of confirmation with retrospective effect i.e. 31.10.1956. He passed away on 27.01.2011. In view of changed circumstances, this Court does not find it appropriate to return finding on merit. 4.
