Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.38 dated 09.04.2016 under Sections 302 and 34 IPC, registered at Police Station Bhogpur, District Jalandhar. I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that the present petitioner is one of the main accused. The complainant and deceased were having dinner and some altercation took place with the present petitioner Ravinder Singh, who is owner of a dhaba, upon which, his servants Gora and Sammi started pushing them and in the meantime, Sammi, servant of Ravinder Singh, brought the sword and gave blow on Jaspal Singh, who died. Keeping in view the facts and circumstances of the present Vineet Gulati 2017.08.03 16:24 I attest to the accuracy and authenticity of this document Chandigarh case, nature and gravity of the offence, without discussing the facts of the
CRM No.M-13975 of 2017 -2case in minute details and without expressing any opinion on the merits of the case, I do not find it a fit case where petitioner is entitled to benefit of regular bail.
Therefore, finding no merit in the present petition, the same is dismissed.
