Mr.Kirat Singh Sidhu,DAG Punjab Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail on behalf of accused petitioner Ranbir @ Rana in case FIR No.91 dated 8.5.2013 under Sections 302,307,148,149 IPC and 25/27 of the Arms Act,PS Patti,Distt. Tarn Taran.
As per allegations petitioner accused is alleged to have inflicted gandasa blows on the backside of Daljit Singh father of Sukhraj Singh(since deceased) qua whose murder the FIR has been lodged.
Petitioner was found to be innocent by the police and accordingly placed in column no.2 at the time of filing of the challan. Petitioner, it appears, has been summoned by the Court to face trial and as such it is contended that custody of the petitioner is not required. CRM-M 14917/2016 a PO has been stayed by this Court in connected petition bearing CRMM 14913/2016. Vide order dated 2.5.2016 while issuing notice of motion it was directed that in the event of surrendering before the trial court within 10 days, petitioner be released on interim bail. At the time of hearing today,learned counsel states that in compliance of the said order, petitioner surrendered before the trial court on 6.5.2016 and was released on interim bail.
Learned State counsel on instructions is unable to refute the said factual position.
In view of the above interim bail granted by the trial court, pursuant to the order dated 2.5.2016, is made absolute. Disposed of.
