* * * * Plaintiff filed a suit for declaration that he was entitled to be promoted as Assistant w.e.f. 01.01.1978. The Trial Court decreed the suit but the First Appellate Court set aside the judgment and decree passed by the Trial Court after holding that the suit is barred by time. Hence, this appeal at the instance of the plaintiff.

This appeal is pending in this Court for the last about 24 years. Today, Ms. Ambika Sood, DAG Punjab appearing for the Advocate General Punjab has placed on record a letter along with report of the Deputy Commissioner sought from the Municipal Corporation wherein it was reported that the appellant has died during the year, 2004. His LRs have not chosen to come on record. In that view of the matter, this appeal has been rendered infructuous and is disposed of as such.
