Rajan Gupta, J (Oral) This is a petition under Section 439 Cr.P.C seeking interim bail. Petitioner is involved in a case under Sections 25, 18 of NDPS Act, allegedly recovery of 5 kg of opium was effected from him. Investigation of the case is still pending. He has moved the instant petition seeking interim bail to enable to perform the last rites of his father, who is stated to have expired on 22.4.2015.. He is stated to be the only son of the deceased.
In view of above, petitioner is directed to be enlarged on interim bail for 5 days commencing 4.5.2015. He shall surrender before the jail authorities on expiry of the period. Interim bail in these terms is granted subject to petitioner's furnishing heavy surety to the satisfaction of Chief Judicial Magistrate, Moga and any other condition which the court may impose to ensure that petitioner does not abscond from the process of law.
Petition is allowed in these terms.
