* * * * M/s Kanodia Traders filed a suit against some of the appellants and others for the recovery of `3,10,437/- being the price of 100 bales of cotton. The Trial Court dismissed the suit by judgment and decree dated September 20, 1989. Plaintiff-Firm preferred an appeal, which came to be heard before the learned Additional District Judge, Bathinda. The learned Additional District Judge vide a detailed judgment allowed the appeal, set aside the judgment and decree of the Trial Court and granted the money decree in the sum of `2,24,593/- with future interest @ 12% per annum from 01.04.1982 to 12.11.1983 and at the rate of 6% from 13.11.1983 till the date of realization against defendants 1, 2, 3, 4 and 7. It is against this judgment that Sh.

Kulwant Rai of M/s Green Roadways Corporation and M/s Shree Radha Traders, Kanpur preferred an appeal, which is pending since 1992. Counsel for the parties did not put in appearance. Notices were, thus, issued to the parties. Notice issued to respondent No.1 was duly served but the respondent did not put in appearance either in person or through a counsel. Appellants could not be served as the firms mentioned do not exist.

In view of the above, no useful purpose would be served to keep this appeal pending. The record of this appeal is, thus, ordered to be consigned to record. Liberty is, however, granted to the parties to get it revived in case of need. Copy of this order be sent to the respective counsel for the parties.
