The appeal is at the instance of the appellant-defendant against the preliminary partition decree passed in favour of the plaintiff, whereby the share to the extent of 3/4th has been determined. It appears that the appellant is not interested in pursuing the appeal.

Dismissed for non-prosecution.

Stay order dated 02.06.1992 and affirmed on 31.10.1992 stands vacated.
