The challenge in the appeal is by the defendant-appellant to the concurrent finding of fact recorded in a civil suit filed for possession by way of pre-emption.

None had appeared on behalf of appellants on 04.02.2020, 17.04.2023 and 17.10.2023.

As per office report, notice issued to the sole appellant received back with the report that he has expired. There is no representation on his behalf. 4.

Dismissed for non-prosecution.

Registry is directed to send a copy of this order to the appellant at the last known address, as also to the concerned SHO of the area to intimate the same. 6.

A period of three months is granted for seeking recalling of this order.
