He prays that the earlier appeal bearing No. CRM-A-241-2023, which is pending before this Court, may be allowed to continue and the instant appeal may be dismissed as withdrawn.

Therefore, CRM-A-390-2023 is dismissed as withdrawn with the aforesaid liberty.
