*** H.S. Grewal, J. (Oral) This is a petition for anticipatory bail filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023 in case bearing FIR No.653 dated 26.10.2024 under Sections 21, 29 of NDPS Act, registered at Police Station Rohtak City, District Rohtak.

Learned counsel for the petitioner contends that the petitioner though not named in the present FIR, has been nominated only on the basis of disclosure statement of his co-accused namely Bishno Devi from whom 9.400 grams of heroin and Rs.14,200/- have allegedly been recovered and she has been granted concession of regular bail vide order dated 30.12.2024 by the court of Special Judge-cum-Additional Sessions Judge, Rohtak. He further contends that the petitioner is not involved in any other case. 3.

A Coordinate Bench of this Court, vide order dated 19.02.2025, had directed the petitioner to appear before the Investigating Officer and join investigation and in the event of his arrest, he was ordered to be released on adinterim bail to the satisfaction of the Investigating/Arresting Officer, subject to Sonia Puri 2025.05.26 17:44 I attest to the accuracy and integrity of this document

Learned State counsel on instructions from ASI-Sandeep states that the petitioner has joined the investigation and is not required for custodial interrogation.

In view of the submissions of learned counsel for the petitioner especially when the petitioner having joined investigation, the order dated 19.02.2025 granting interim bail to the petitioner is made absolute. 6.

However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
