This Court vide order dated 27.09.2018 had issued the notice to the appellants and the respondents.
As per office report, appellant Nos.1(i), 2(i), 2(iii), (ii) have been served, but there is no representation on their behalf, whereas appellant Nos.1(iii), 1(iv) and 2(iv), remain unserved. The present regular second appeal is directed against the concurrent findings of fact, whereby the suit for declaration with consequential relief of permanent injunction, was dismissed by the trial Court and affirmed by the lower Appellate Court. It appears that the appellants must have resiled with the factual aspect.
Dismissed for non-prosecution.
