....Petitioner versus State of Haryana and anr.
...Respondent
CORAM:
HON'BLE MS. JUSTICE RITU BAHRI
Present:
Mr. B.S. Dhillon, Advocate for the petitioners.
**** RITU BAHRI , J. (Oral) Prayer in this petition is for quashing of F.I.R No. 0128 dated 28.11.2015 under Sections 406/498-A/506/34 IPC. Learned counsel submits that petitioners are real uncle and aunt of husband of the complainant. Petitioners have no concern with the matrimonial matters of in-laws family of respondent No. 2. They are residing separately and even a certificate to this effect dated 09.04.2017 (Annexure P-8) has been issued by the village Sarpanch. Due to the dispute between husband and wife, the present petitioners have been roped in, being the uncle and aunt of husband of respondent No. 2.
After arguing for some time, learned counsel for the petitioners wishes to withdraw the petitioner with a liberty to take all the pleas before the trial Court.
Dismissed as withdrawn with the aforesaid liberty. Keeping in view the above fact that the allegations levelled against the present petitioners are general in nature and the fact that they senior citizens, the personal appearance of the petitioners is exempted before the trial Court, subject to the following conditions:- (i) petitioners shall be represented through counsel; (ii) shall not delay/stall the trial proceedings; (iii) shall not dispute their identity as an accused: (iv) shall have no objection if the prosecution evidence is recorded in their absence but in the presence of their counsel; (v) shall appear before the trial Court as and when required by the trial Court; and (vi) any other condition which the learned trial Court may impose. 27.04.2017 (RITU BAHRI) G Arora JUDGE Whether speaking/reasoned Yes Whether reportable No GAURAV ARORA 2017.04.28 15:00 I attest to the accuracy and integrity of this document Chandigarh
