Learned counsel appearing on behalf of the appellant submitted that the suit for declaration claiming ownership on the basis of the Will by laying challenge to the mutation, has been dismissed by both the Courts below.
However, counsel for the appellant in the trial Court, sent a communication dated 10.02.1998 that the sale deed in respect of the suit property had already been registered on 23.12.1997 and requested to withdraw the regular second appeal. The said communication is taken on record.
