The present appeal pertains to the year 1993. Vide order dated 21.03.2024 notices were issued to the appellants as counsel earlier representing them had pleaded no instructions in the matter. Notices issued to the appellants have been received back unserved with the report 'not residing at the given address'.

An application being CM-5145-C-2020 has been filed for placing on record a compromise which has allegedly been effected between the parties. However, in the absence of the appellants, no order can be passed qua the compromise. Since, no one has appeared on behalf of the appellants today and there is no other address available with the Court for effecting service of the appellants except the one mentioned in the memo of parties and in the judgments and decrees passed by the Courts below and is the same on which the notices were sent, this Court is left with no other option but to dismiss the present appeal for non-prosecution.
